DEFINITIONS


1. Within these terms and conditions, the following words shall have the following meanings:
a. The term "company" shall mean BBI Heating.
b. The term "customer" shall mean the person or organisation for whom the company agrees to carry out works and/or supply materials.

c.  These terms and conditions do not apply to renewable installations. Please contact us for the RECC compliant terms and conditions. Thank you.

 
1. PROVISION OF SERVICES


a. The price quoted is open for acceptance within 30 days providing that the provision of services commences within 60 days from the date of the quotation. Services commencing after the set time may be subject to a revised quotation price.
b. The time estimate if provided for completion of installation is a best estimate of the likely time scale prior to commencement of the services provision, and the company cannot accept liability for any cost, losses or expense incurred by the customer as a result of any delays beyond our control.
c. Unless specified in the quotation, removal of general waste/rubbish or any dangerous waste material e.g., asbestos is not included.

d. Refrigerant gas recovery is carried out as per F-Gas regulations and incurs an additional cost if not already included in the quotation. 

e. Chemical treatment of central heating can reveal leaks on the system. This cannot be covered by any estimate that does not expressly include such remedial work; nor can the company's insurance policy cover any damage or additional costs associated with any related leak.
f. The conversion of a system to a higher working pressure can lead to small pre-existing holes or loose pipes in the heating system to start leaking or become more noticeable. This shall not be deemed the responsibility of the company. Should such a failure occur additional work may be required at an additional cost.
g. Working at height, 10m maximum.  Although every effort is made to access areas by ladder, if it is found after start of works that access is not possible in a safe manner, and no price has been given for scaffolding etc., the company will quote an additional charge for any equipment needed.

h. The company requires that the site be cleared by the customer prior to commencement of works. A delay fee may be chargeable for any clearing work. Requests to move any furniture or possessions are at the owners own risk as the company will not accept liability
i. Unless specified, radiators will not be removed for decorating by the company. Removal of a radiator invalidates the company's guarantee unless carried out by the company.

j. The company does not accept any knock-on-effects to existing pipework, fittings, taps, showers or radiators because of a new installation.

k. The company will take all reasonable care while providing its services. However, the customer accepts possible damage to and/ or a need for removal of: decoration, boxing, cupboards, units, fittings, flooring or carpet during the installation. Redecoration, making good, refitting units, cupboards, boxing and flooring or professional carpet fitting and cleaning by the company is not included in this quote unless specified. This provision does not exclude the company’s responsibility for damage beyond what is reasonably commensurate with contracted work.


2. PAYMENT


a. For services and materials, an initial deposit of 25% of the total cost may be required prior to the commencement of services.

b. Payment schedule is to be agreed by the customer and company before the commencement of services either in writing or verbally.
c. Payments are strictly 7 days from the invoice date unless other payment terms have been mutually agreed in writing.

d. Overdue accounts to individual customers and business customers will become subject to late payment charges set at a daily interest rate of 8% (over Bank of England base rate) and compensation for debt recovery costs as per the Late Payment of Commercial Debts (Interest) Act 1998. 
e. The company reserves the right to withdraw from site if the contract payment schedule is not adhered to.

f. All deviations to a provided quote and/or additional materials not included in said quote will be priced and added at the end of the contract, having been previously agreed upon by the customer and the company verbally or in writing.

g. An hourly rate of £60.00 + VAT (or any part thereof) will be charged for labour for services not included in an agreed quote/contract.

h. Modifications to and/or removal of work done and of materials requested by the client will be charged at an hourly rate of £60.00 +VAT (or any part thereof) plus the cost of additional materials and no refund given for materials already used.

i. The Government grant (BUS) of £7500 is subject to the acceptance by Ofgem of the information provided at the redemption stage once the installation is complete. It is not guaranteed by the company that these funds will be granted. If the funds are not granted by ofgem, then the customer accepts liability to pay the discounted value of £7500 to company

 

3. RENTENTION OF TITLE

​

a. The company will retain ownership of any materials until full payment of balance due is received from the customer. Any materials can be recoverable by the company in the event of non-payment. The customer agrees to allow access to site/premises for this purpose.

4. GUARANTEE


a. Pluming and heating installation work carried out by the company carries a 12 month workmanship guarantee from the date of commissioning. Servicing, maintenance or repair work is guaranteed for 28 days from the date of invoice.

c. Renewable energy systems and boilers installed by the company carry a 24 month workmanship guarantee from date of the commissioning.

d. Materials supplied are checked to ensure they are fit in terms of quality and purpose and are subject to manufacture warranty. The company’s workmanship warranty does not cover any repairs/ replacements needed or damages caused if it transpires materials used are faulty due to unforeseen or unobvious manufacturing defects, e.g. internal defects.

e. The company cannot guarantee any services, parts and equipment supplied to the customer if:

  1. They suffer misuse, are treated negligently or if the company's work is repaired, modified, or tampered with by a third party.

  2. The material used is supplied by the customer.

  3. The company indicates that further works need to be carried out.

  4. The installation is not maintained in accordance with manufacturer’s instructions, by way of example, boilers must be serviced annually.


5. CANCELLATION POLICY


a. If the customer cancels an order and/or service placed, the following terms apply:

  1. The customer has the right to cancel without giving any reason within a 14 day cancellation period beginning the day of acceptance of an offer. The customer will be refunded any monies made as a deposit. If special orders have been agreed you may need to pay a restocking charge.

  2. Cancellation of a contract to be in writing via post or email only so as to avoid doubt. Phone calls or text messages are not accepted. 

  3. Cancellation of services after the 14 day cancellation period will incur a cancellation fee which is 5% of the original quote.

  4. If the customer has signed a “express request” and has instructed any work to begin within this 14 day period, any costs incurred for administrative tasks, work already commenced, and materials installed/ used and ordered prior to the time of cancellation will be payable immediately and in full.

  5. If the contracted work is completely finished within the 14 day period, then right to cancel is lost and payment in full is due.

  6. Missed appointments at tenanted properties are subject to a cancelation fee of £25 + VAT (at the company’s discretion) if a 24hr notice of cancellation is not given.

6. TERMS OF USE


a. These terms and conditions and all contracts awarded between the company and the customer shall be governed and construed in accordance with English Law and shall be subject to the exclusive jurisdiction of the English Law.
b. Acceptance of our goods, services or quotation is automatic acceptance of these terms and conditions.

c. The company will use customer/tenant data as set out in the company privacy policy.

7. CHANGES TO THESE TERMS AND CONDITIONS

We reserve the right, at our sole discretion, to modify/ replace these Terms & Conditions by posting the updated terms and conditions on our website. Contracts will not be affected by changes made after being accepted
